DISTRIBUTION OF IBM LICENSED PROGRAMS AND LICENSED PROGRAM MATERIALS AND MODIFIED AGREEMENT FOR IBM LICENSED PROGRAMS Today IBM is announcing that, for selected new IBM licensed programs and selected new versions and releases of currently available IBM licensed programs, certain licensed program materials may be either made available on a restricted basis or not available; when the licensed program materials are not available, the licensed programs will be distributed in object code only. Restricted materials may include machine readable source code, microfiche, logic manuals, and selected basic materials. Licensed programs will be individually reviewed to determine what materials will be available for distribution. The review will evaluate whether adequate problem determination and problem source identification aids are available and determine if sufficient user exits are provided in products where they are required. Consequently, on the basis of this review, IBM will provide licensed programs: . Without licensed program materials, or . With selected licensed program materials available as "Restricted Materials of IBM," or . With the licensed program materials available as they are today. Programs delivered with selected modules in object code only will not have licensed program materials available for object code modules, and materials may be restricted for source modules. Programming announcements will indicate how a licensed program will be distributed. Licensed program materials currently available from PID will not be affected by this announcement. This new approach will result in increased protection of IBM's programming investment and technology. Agreement for IBM Licensed Programs The new Agreement for IBM Licensed Programs includes terms and conditions pertaining to restricted materials that affect the following paragraphs of the agreement: . Protection and Security of Licensed Program Materials Restricted materials: The customer is authorized by the new terms in the agreement to use restricted materials only in the following ways: . Interfacing user programs or products . Making user modifications . Performing problem determination, problem source identification, and problem resolution activities Other changes: Included in the modifications to the agreement are two additional changes relating to asset protection that appy to all IBM licensed programs: . Reverse compilation or reverse assembly is prohibited. . Existing terms and conditions with respect to redistribution of IBM licensed programs are clarified. Implementation of new terms and conditions These new terms and conditions are effective automatically on September 1, 1983 for all current customers of IBM licensed programs. For customers requiring IBM licensed programs with restricted materials prior to this date, the new terms that pertain to restricted materials and asset protection become effective when the IBM licensed program is ordered. A new Supplement to the Agreement for IBM Licensed Programs is also available with this announcement. Printed on this Supplement are the new terms pertaining to restricted materials and asset protection. IBM and the customer will be required to sign the new Supplement if a customer orders a licensed program with restricted materials prior to September 1, 1983. As an alternative, the customer may sign the new Agreement for IBM Licensed Programs, which would supersede the existing license agreements. Distribution of object code only IBM licensed programs made available in object code only will provide user exits to accommodate user extensions, if required. In addition, adequate problem determination and problem source identification guides and aids will be provided to assist the customer with problem resolution activities. Source materials will not be available in any form for object-code-only modules or programs. These new facilities will enhance software serviceability and reduce the requirement for customer modifications. Currently announced programs: The following announced licensed programs will contain some restricted materials: MVS/SP - JES 2 Version 2 5740-XC6 MVS/SP - JES 3 Version 2 5665-291 Data Facility Product 5665-284 TSO Extensions 5665-293 RMF Version 3.1 5665-274 Assembler H Version 2 5668-962 Systems Modifications Program Extended 5668-949 MVS/SP - JES2 1.3.3 5740-XYS MVS/SP - JES3 1.3.3 5740-XYN VM/XA Migration Aid 5664-169 Education: Some of the future education courses offered at the Advanced Education Centers will utilize restricted licensed materials. The names of these courses and the enrollment procedures for them will be made available at a future date.
